These terms include our rules on what you can and cannot do on Alvalan (section 10, Acceptable use).
1. Who we are
Alvalan is operated by PhygitalTwin Ltd, a company registered in England and Wales (company no. 14146111), whose registered office is Unit 4 Grovelands, Boundary Way, Hemel Hempstead, Herts, HP2 7TE ("Alvalan", "we", "us"). Contact: info@alvalan.com.
These terms apply when you create an account or use Alvalan at app.alvalan.com (the "Service"). By creating an account you accept these terms, our Privacy Policy and our Cookie Policy.
If your organisation has signed a separate agreement with us, that agreement takes priority where it conflicts with these terms.
2. Eligibility and your account
- You must be 13 or over to use Alvalan. If you are under 18, you need your parent or guardian's permission, and they should read these terms with you.
- If you use Alvalan for a business, you confirm you are authorised to accept these terms on its behalf.
- You sign in with Google or with an email address and password. Keep your login details secure; you are responsible for activity on your Alvalan account. Tell us straight away at info@alvalan.com if you think someone else has used it.
- One account per person. Accounts created to collect extra credits will be closed.
- The information you give us must be accurate.
3. Open beta
Alvalan is in open beta. That means:
- Features may change, be removed or be unavailable without notice.
- Outputs may contain errors. Automated weight painting and auto-fit are still being refined, and some exports may need touch-up in Blender.
- We may pause or limit access, for example to manage demand or cost.
- We will give at least two weeks' notice before beta ends.
We want your feedback. You can reply to our emails or use the chat on the platform.
4. Credits
Some actions on Alvalan use credits. The cost of each action is shown before you take it.
- Beta credits. Each beta account receives 10,000 free credits, once.
- Earned credits. You can request extra credits by clicking Top Up and sending an email to us. We give out credits at our discretion.
- Limits. The number of generations you can run in Beta accounts depends on how many credits you have in your account.
- Failures are free. Credits are only deducted when an action completes. If it fails, you are not charged.
- Expiry. Free beta and earned credits expire when beta ends. Credits you have paid for do not expire at the end of beta.
- Credits have no cash value, cannot be transferred or exchanged for money, and cannot be sold.
- We may remove credits obtained in breach of these terms, for example through duplicate accounts.
5. Your content
"Your Content" means the files, sketches, designs, textures and images you upload, and the 3D models, textures and exports the Service creates from them.
- You own Your Content. We do not claim ownership of your designs or the outputs made from them.
- Licence to us. You give us a non-exclusive, worldwide, royalty-free licence to host, store, copy, process and transform Your Content, only to run the Service for you, keep it secure, and fix problems.
- Quality checks. When you export, we record a short video of the garment to check its quality. These videos are stored privately and deleted on request (see our Privacy Policy).
- AI training. We do not use Your Content to train AI models without your permission. We use paid plans with our AI providers, Tripo and OpenAI, whose terms prohibit them from training on your inputs (such as sketches and reference images) or on the outputs. We do not share your 3D models with any other third party, other than the hosting and service providers that run Alvalan for us.
- Featuring your work. If you tag Alvalan in a post or enter Creator of the Week, you allow us to reshare and feature that design on our website and social channels, credited to you. You can ask us to remove it at any time.
- Your promises. You confirm you own Your Content or have permission to use it, and that it does not infringe anyone's rights or break section 10.
Keep your own copies. During beta we do not guarantee that uploads, generations or exports stay stored in your account. Download anything you want to keep.
6. Selling what you make
6.1 Your items are yours to sell. You can use items you make with Alvalan commercially. That includes selling them on the Roblox Marketplace, using them in Roblox experiences and other games, and using them in your own products and marketing. Alvalan takes no fees, royalties or share of your revenue, during beta or after.
6.2 Our templates and Library assets. "Alvalan Assets" means the base garment templates, prints, decals, 3D decals, materials, textures, colourways and other assets we provide in the editor and Library, including ones generated by our AI tools. We give you a worldwide, non-exclusive, royalty-free, perpetual licence to use, modify and combine Alvalan Assets in items you make with Alvalan, and to sell and use those items commercially as described in 6.1. This licence continues for items you have exported, even after beta ends or your account closes.
6.3 What the licence does not allow. You may not:
- sell, share or give away Alvalan Assets on their own, or as templates, asset packs or kits;
- claim exclusive ownership of an Alvalan Asset, or register it as your trademark or design;
- stop other people using the same Alvalan Assets;
- use Alvalan Assets to train AI models or to build a competing library or tool.
6.4 Not exclusive. Other creators can use the same templates and assets, and AI-generated outputs may look similar to other people's. We do not guarantee that an item is unique.
6.5 Platform rules and fees. When you sell on Roblox or anywhere else, that platform's terms, fees, commission and moderation apply. Items uploaded from an unchanged template may be rejected or removed by Roblox moderation. You are responsible for what you upload.
6.6 Your own prints and files. If you add your own prints, textures or other files, you must own them or have permission to use them commercially.
6.7 Roblox requires original content. Roblox only accepts items that are original and that you have the right to sell. Treat our templates and Library assets as a starting point: customise them so the item is your own work, and never copy other creators' items. Roblox decides what it accepts and may reject or remove items it considers unoriginal.
7. AI-generated outputs
Alvalan uses AI to generate 3D models from sketches and images. AI outputs can be inaccurate and may resemble existing designs. We do not guarantee an output is free of third-party rights. Check outputs before you use, sell or upload them.
8. Roblox and other platforms
Alvalan is not affiliated with or endorsed by Roblox. We are not responsible for another platform's decisions, including rejecting, removing or restricting your items.
9. Our platform
The Service, its software, design, templates and Alvalan Assets belong to us or our licensors. Apart from the licence in section 6, you may not:
- copy, modify, reverse engineer or resell the Service;
- scrape it, or access it with bots or scripts other than those we provide;
- use it to build a competing product.
If you send us feedback or ideas, we may use them without obligation to you.
10. Acceptable use
10.1 Respect other people's designs. Only upload and create what you own or have permission to use. Do not:
- upload another designer's or brand's designs, sketches or files without permission;
- recreate recognisable branded garments, logos, monograms or trademarks you do not own or license;
- copy other creators' Roblox items or 3D assets;
- use prompts or reference images designed to reproduce someone else's work;
- upload images of real people without their permission.
10.2 Content we do not allow. Do not use Alvalan to create, upload or share content that:
- is sexual or pornographic;
- sexualises minors in any way;
- promotes hatred or harassment based on race, ethnicity, nationality, religion, disability, sex, gender identity, sexual orientation or age;
- promotes violence, terrorism or violent extremism;
- promotes self-harm;
- depicts or promotes illegal activity or goods;
- is designed to deceive or defraud.
10.3 Follow platform rules. Items you export for Roblox or any other platform must also follow that platform's community standards and creator rules.
10.4 Use Alvalan fairly. Do not:
- create more than one account to collect credits;
- get around generation limits, credit caps or security controls;
- use bots, scripts or scrapers other than those we provide;
- reverse engineer the Service or its models;
- resell or share access to your account;
- disrupt or overload the Service.
10.5 Reporting infringement. If you believe something on Alvalan infringes your rights, email info@alvalan.com with:
- your name and contact details;
- the work you own and how it is infringed;
- where the content appears on Alvalan;
- a statement that the information is accurate and you are the rights owner or authorised to act for them.
We review reports promptly and remove content where appropriate. We close the accounts of people who infringe repeatedly.
10.6 What we may do. If you break this section, we may remove content, withhold or remove credits, and suspend or close your account. Where content is illegal, we may report it to the relevant authorities.
11. Closing your account
- You can close your account at any time by emailing info@alvalan.com. We delete your account and content within 30 days, as set out in our Privacy Policy.
- We may suspend or close your account if you break these terms, if required by law, or if we stop offering the Service. Where reasonable we will give notice first.
- When your account closes, unused free credits lapse. Your right to sell items you have already exported continues.
12. Our responsibility to you
During beta the Service is provided "as is" and "as available".
- If you use Alvalan as a consumer, you have legal rights that these terms do not affect. We are responsible for foreseeable loss caused by our breach of these terms or failure to use reasonable care.
- If you use Alvalan for business, we are not liable for loss of profit, revenue, business, goodwill or data, or any indirect loss. Alvalan is free during beta, so our total liability is limited to £100.
- Nothing in these terms limits liability for death or personal injury caused by negligence, for fraud, or for anything else that cannot be limited by law.
Business users' responsibility for content. If you use Alvalan for business, you will cover our losses and reasonable legal costs from any third-party claim that Your Content infringes their rights or breaks the law.
13. Changes to these terms
We may update these terms. We will email you whenever we do, and for material changes we will email you at least 14 days before they take effect. If you do not agree, you can stop using Alvalan and close your account.
14. General
- These terms are governed by the law of England and Wales, and the courts of England and Wales have jurisdiction. If you are a consumer in Scotland or Northern Ireland, you may also bring proceedings in your local courts.
- You may not transfer your rights under these terms. We may transfer ours to a company that takes over the Service.
- If any part of these terms is unenforceable, the rest still applies.
- We send notices about your account and these terms by email or on the platform.
- Sections 5, 6, 10, 12 and 14 continue to apply after your account closes.
